Terms and Conditions

The following user terms apply to any interaction you have with Janets. This includes but is not limited to, accessing our website, purchasing courses, use of our online learning platform or online study materials. They affect your rights and liabilities under the law. It is assumed that if you interact with Janets in any of the ways listed, you agree to these terms and conditions.

Terms

1.1 These user terms (henceforth referred to as “Terms”) constitute an agreement between Janets (“we” or “us”) and the customer (“you”)

1.2 The user terms apply during any interaction between you and any website, platform or application used to access our services. You are assumed to agree to these terms and conditions when you access our services as defined here.

1.3 We reserve the right to amend these terms at any point. The revised terms will be made available on our website. If you do not agree to the new terms, you reserve the right to terminate your agreement. However, if you continue using our services, it will be assumed you have accepted the amended terms.

1.4 Professional instructors and other third parties provide courses through the Janets online learning platform. As such, these terms apply only to the provision of services by us, and not to the course content provided by these third parties.

1.5 We are not liable for the content of courses delivered through the Janets platform. Responsibility for the relevancy and accuracy of course content lies solely with the instructor.

Registration

2.1 You must register for an account with Janets to access courses and purchase services from us. Registration requires you to provide your full name and contact information.

2.2 Any personal data shared during registration will be subject to the data protection obligations set out in our privacy policy below, according to the Data Protection Act 2018 and the UK GDPR.

2.3 Upon registration you will be required to create a password. We will not be held liable if you fail to keep your password confidential and/or otherwise disclose it to a third party. Should you believe a third party is accessing your account, you should contact us immediately, and the appropriate action will be taken.

2.4 Failure to enter your correct email address when registering may result in you being unable to access your purchased courses. We will not be held responsible if you enter an incorrect email address, whether in error or otherwise. If you become aware that you entered an incorrect email address, for whatever reason, you should contact us immediately to amend the information.

2.5 When you register for an account with Janets, you will be emailed promotional offers on courses or other services in the future. 

2.6 We reserve the right to suspend or otherwise close your account at any time if you are found to be in breach of these user terms. You will, therefore, be unable to purchase further courses through us or access any of our other services as a result.

Purchases

3.1 Upon purchase of any courses or services from Janets, we will take payment immediately. A purchase will not be confirmed until you have made a payment and received confirmation in the form of an email.

3.2 At the point of purchase, you enter an agreement to abide by the terms laid out on this page. Your course will be subject to any relevant terms found herein.

3.3 The price of courses, certificates or services you purchase from us will be clearly stated on the website or application you make your purchase. If you are undercharged due to an error or any other reason, we are not liable to supply you with the course at the stated price.

3.4 Customised offers available on the Janets website will become invalid and expire after 30 days unless the offer specifies a different duration.

Course content

4.1 We make efforts to ensure course materials are of high quality, but ultimately, the responsibility for delivering the course lies with the respective instructor or organisations. Therefore, we cannot be held liable if you find the course unsatisfactory or otherwise fail to meet your requirements or expectations.

4.2 Should you come across any technical issues that prevent your access to course materials, including but not limited to system outages for repairs, maintenance or upgrades of the online learning platform, we endeavour to resolve them as quickly as possible.

Account Termination

5.1 Should you be found to be in breach of these user terms in any way, we reserve the right to suspend your account.

5.2 We reserve the right to refuse any further interaction with you after suspending your account, including access to further services or courses. Attempting to circumvent this right by creating a new account may result in us terminating the new account and any other interactions with you.

User-Generated Content

6.1 These terms apply to any situation wherein a user may share content through our platform, including course instructors.

6.2 We reserve the right to remove any content from our platform without warning and without giving a reason. Any content which does not adhere to our standards or these terms may be removed at any time.

6.3 When sharing content through our platform, you assert that you are the original author of the content and that you own all the intellectual property rights of that content. This does not apply to any third-party videos or links included in your course materials or content that consists solely of information.

6.4 Course content provided by you for our platform is your own responsibility. We will not be held liable for any content you share that is considered defaming, in breach of intellectual property rights, fraud or privacy laws, or any other similar claims.

6.5 You agree that you will not provide content which actively promotes illegal activities or disseminates illegal information, promotes bigotry or hate speech of any kind against any group or individual, contains violent or sexually explicit material, promotes libellous or violent conduct, or infringes on personal privacy or intellectual property rights.

Our Liability

7.1 Janets will not be held liable for any potential losses (including but not limited to business, financial, personal or economic) due to accessing courses or other services through our platform.

7.2 Any liability in relevant cases, as explained in these user terms, is limited to the total you have paid for courses or services purchased through us.

7.3 Liability claims cannot be brought against us any later than 12 months after the initial purchase of a course or service.

7.4 Nothing in this Term limits or excludes our liability for death or personal injury.

International Use

8.1 There is no guarantee that the information offered within our services or courses is appropriate or applicable in locations outside of the United Kingdom. The responsibility for accessing information in other countries lies entirely with you.

General

9.1 These user terms are governed in accordance with the laws of England and Wales. Accepting these terms means you submit to the non-exclusive jurisdiction of the English and Wales courts.

9.2 Janets cannot be held responsible for any breach of these terms caused by circumstances beyond our control.

9.3 We reserve the right to make any changes to the content or format of our courses, services, platform or site at any time, with no former notice. This does not affect your rights or the agreement made at the time of purchase.

Cancellation and Refund

10.1 Where services are available via online access, you will be entitled to cancel the access within 14 days of your purchase. However, if you choose to start the Course within this period, then you will lose your right to cancel.

10.2 On cancellation, you will receive a full refund. If an annual subscription is automatically renewed, a particular exception will come into effect. In this situation, after the annual subscription is renewed following its original term ending, the learner will no longer have the right to request a refund, regardless of any reason.

Annual Subscriptions, Rights & Obligations

11.1 A Janet’s annual course subscription entails a payment arrangement where learners pay an upfront fee for one year of access to a set of courses. Typically, within this subscription period, learners can access a variety of courses.

11.2 Subscribers to Janets on an annual basis are limited to enrolling in a maximum of 30 courses concurrently. They can only start a new course after finishing one of the initial 30, ensuring a total course count of 30.

Please note that the annual subscription does not cover courses offered by Awarding bodies, bundles and career path/career bundles listed on the Janets website.

11.3 The assignment of courses to learners is contingent on availability. If a course becomes unavailable for any reason after being in the course library during the subscription period, the learner cannot enrol in it. Janets will not be held responsible, but the learner can take the course once it becomes available again in the library.

11.4 In the event a learner purchases an annual subscription at a discounted rate from Janets, they forfeit the right to request a refund, regardless of the reason, due to the discounted price.

11.5 If a learner completes 50% or more of multiple courses, they are ineligible to request a refund from Janets, regardless of the circumstances.

To clarify, when a learner buys an annual subscription from Janets for online course access, if they complete at least 50% of the courses and later seek a refund after finishing several courses, Janets reserves the right to deny their request, as outlined in the Terms and Conditions Agreement.

11.6 Auto-renewal is applicable to the Annual Subscription. Upon renewal following the expiration of its term, the learner loses the right to request a refund for any reason.

Subscriber Warranties, Rights, Representations, & Obligations

11.1 According to your subscription type, you will be authorised a limited, non-exclusive, revocable, non-transferable, and non-sublicensable access to services subject to the following Terms of Use. 

11.2 We are not obligated to maintain the Website or maintain its current form by consenting to provide access. We have the authority to change, enhance, modify or upgrade any service. 

11.3 In addition, we can convert a Subscriber to a new version at any time at the Company’s sole discretion, as long as it is not detrimental to your use of the services. We will ensure you receive a prior notice (unless the change is critical for business or outside the Company’s control. In such circumstances, the Company will clarify).

11.4 You must follow all the rules or regulations published by us regarding Subscriber Conduct. The Terms of Use include all these rules and regulations with references. If you fail to follow the Terms of Use or lack the credibility to do so as per the Company’s review, we possess the right to deny you access to any service.

  1. You agree that we may, but are not bound to, monitor the Services or any part thereof or oversee compliance with the Terms of Use in its sole discretion. 
  2. You and any other Subscribers added to their membership (“Authorised End Users” or “Multi-User Subscriptions”) commit, acknowledge, and accept that:
    • Third-party access privileges are not permitted,
    • They must not access, store, distribute, or transmit any viruses.
    • All Services are to be utilised abiding by the applicable laws and regulations,
    • The Services or any component thereof can not be rented, leased, sublicensed, resold, distributed, transferred, copied, or modified,
    • You will not reverse engineer or seek to construct the source code from the object code made available hereunder, nor decompile, create, or attempt to create, the source code from the object code made available hereunder,
    • You will not copy, distribute, edit, publicly display, publicly perform, republish, download, store, or transmit the Services or any part of them,
    • You will not remove or attempt to remove or change any copyright, trademark, or other proprietary rights notices from materials copied from our Website or Services provided, 
    • You are responsible for obtaining, installing, operating, and maintaining the necessary hardware and software, along with ensuring network connections and telecommunication lines required to access and use the Services,
    • You are not to use the Services in any way or in conjunction with any content, data, hardware, software, or other materials that may infringe or violate any third-party patent, copyright, trade secret, trademark, or intellectual property right, or anything that may constitute defamation, libel, violation of the right of publicity or other third-party rights, or that is a violation of any law or invasion of privacy.

Right to Cancel Order

12.1 Some of our exclusive courses are not included in subscription packages. Those are only available for singular purchases. The following policies are applicable for such courses:

  1. You can cancel the order within 14 days after the order has been delivered. But you must provide a proper reason for cancelling. This 14-day period grants a conditional right to cancel.
  2. How to cancel: Simply email us at ….. or call us ….. with the order details to cancel the order.
  3. It is also mentionable that a Subscriber can only have 30 active courses at any time. They can only start a new course after finishing one of the initial 30, ensuring a total course count of 30.

Right to Cancel Subscription

13.1 Our Annual Subscription is renewed after 12 months. However, You can cancel your membership at any time from your account. 

The subscription will automatically renew unless cancelled by the subscriber or Janets. If not cancelled, it will be extended for the following year. Subscribers will be charged for the next billing cycle based on their selected payment method.

13.2 If you cancel your subscription, you will lose access to all courses you enrolled for during your membership at the end of your billing period. 

13.3 You can view recordings of classes you’ve already attended, but not future ones, and you will not be able to add a new course. 

13.4 To delete your account, please contact Janets’ support. 

Cancellation Related Changes

14.1 The membership can be cancelled at any time. 

14.2 You can finalise cancellation over the phone or from your profile.

14.3 You can cancel your membership and benefits by going to the Membership and Payments tab, where you will find options like pausing your membership or switching to a lower-cost plan. 

14.4 If you signed up for Janets through a third-party account (such as an app store) as a Payment Method and want to cancel your membership, cancellation may need to be done through that third party. For instance, visit the account with the applicable third party and turn off the auto-renewal option or unsubscribe from the Janets service.

14.5 A cancellation feature is included in the Members Area to make the cancellation process swift. Membership can also be terminated by filling out this cancellation form and returning it.

14.6 The right to terminate the services:

14.7 If you do not comply with the Terms and Conditions, including payment obligations, We reserve the right to terminate your access to the Services.

14.8 You might receive a letter regarding the termination of Services. You will be notified in advance and reimbursed (for the amounts paid in advance) for services that will not be provided.

14.9 You will be able to renew it at any time in the future, even after cancelling the membership. The account will be charged for the following year if you want to continue. Then, you will go back to the plan you had cancelled previously.

14.10 The existing subscription will continue until the end of its current term. And then switch to the ‘One Course Plan’ if you choose a reduced-price plan known as a ‘One Course Plan’.

14.11 To clarify further, if you are currently subscribed to a higher-priced plan (such as the annual subscription), the current subscription will remain as is, with the membership advantages associated with the current plan. However, the plan will change to One Course Plan at the end of the subscription period.

14.12 We have the authority to change our service plans and prices at any moment. 

14.13 Suppose there are any changes in the pricing; in that case, you will be informed in advance via the member’s user interface, the membership and payments user interface, emails or other reasonable ways. 

14.14 The new pricing will be effective at the beginning of the next subscription month after the price change date. As a precaution, we recommend reading any pricing change message carefully.

14.15 Please reach out to us if you have any payment or other membership-related questions.

14.16 We do not offer refunds or credits for partial membership periods, lessons, or Courses.

14.17 Refunds will only be issued if there is a reasonable cause, as defined by incorrect content or pricing, certificate, course materials, assignment retakes, or any other optional course content from the members’ area, checkout page, or any other cause deemed valid by us.

14.18 When a subscription is renewed, including purchases made via promotional communications, email, SMS, or any other method, unless there is a valid cause, refunds are not available, as defined by inaccurate content pricing or other circumstances outlined in the Terms of Use.

Lifetime Prime Membership

15.1 Lifetime Prime Membership alone does not grant access to courses offered by Awarding bodies, bundles and career path/career bundles listed on Janet’s website. These are instead available as part of our special offerings or as a one-time purchase. Please note that the payment of Lifetime Prime Membership is non-refundable if purchased during a promotional campaign.

15.2 The transfer of lifetime access to any third party by the subscriber is prohibited.

15.3 If a learner buys a lifetime subscription at a reduced rate from Janets, their ability to request a refund will be rendered invalid after acquiring the aforementioned discounted lifetime subscription.

15.4 After obtaining a lifetime subscription from Janets and completing 50% or more of several courses, the learner won’t be able to ask for a refund from Janets, irrespective of the reason.

15.5 Janets retains the authority to revoke the subscriber’s lifetime access in case of violating our terms and conditions.

15.6 It is also mentionable that a Lifetime Prime Member can only have 30 active courses at any time. They can only start a new course after finishing one of the initial 30, ensuring a total course count of 30.

Confidentiality

16.1 Both Janets and the Customer agree to the following provisions regarding Confidentiality, which shall remain in effect during the enforcement of this term and for five (5) years after its termination:

16.2 The parties shall maintain the confidentiality of all Confidential Information and shall not disclose such information to any third party except as provided in these Terms or as authorised in writing by the other party. 

Confidential Information shall not be used for any purpose other than as contemplated by these Terms.

16.3 Neither party shall make any copies of, record in any way, or part with possession of any Confidential Information and shall ensure that their directors, officers, employees, contractors, agents, or advisers do not breach the confidentiality provisions of these Terms.

16.4 Either party may disclose Confidential Information to its subcontractors or suppliers or group companies, any governmental or regulatory authority, or any employees or officers of such parties, provided that such disclosure is necessary for the purposes contemplated by these Terms, or as required by law, and provided that the recipients are aware of the obligations of confidentiality and agree to keep the confidential information confidential and to use it only for the purposes for which the disclosure is made.

16.5 Either party may use or disclose Confidential Information that has become public knowledge through no fault of the receiving party, provided that the receiving party does not disclose any part of such Confidential Information that is not already public knowledge.

16.6 The provisions of this Clause shall continue to be binding notwithstanding the termination of the Term for any reason.

16.7 Notwithstanding anything contained in Clause, Janets shall employ industry-standard systems, applications, and protocols to safeguard personal information and mitigate the likelihood of theft, damage, loss, unauthorised access, or misuse of information. However, Janets cannot guarantee absolute protection or security of any personal data stored by us or any third-party service providers, despite our best efforts to preserve your privacy and data integrity. 

Severability

17.1 Should any clause within these Terms be deemed unlawful by a court with appropriate jurisdiction or any lawful authority, said clause shall be modified and construed in a manner that most effectively accomplishes the intended goals of the original provision as allowed by law. 

17.2 The other stipulations in these Terms of Service will continue to hold their complete legal validity and impact.
